Compensation Claims, how to go about making one Part Two



As well as claiming for compensation based on ‘general damages,’ which, as previously mentioned refers to the pain and suffering you have endured due to an accident that was caused through no fault of your own, you can also claim for compensation based on the term ‘special damages.’

‘Special damage’ is a legal term that moves away from your initial injuries and the pain that was caused by them and points more towards compensation that is paid out to cover your financial losses/any expenses that you have encountered from the accident.

In order for you to gain success in claiming for compensation based on special damages you need to be able to provide proof that the accident you became the victim of, that was caused through no fault of your own and that you have suffered not only injury but financial loss as a result of it. The way in which you can go about doing this is keeping hold of any documents you now have that are linked to the accident such as receipts. If you have had to travel to numerous hospital or doctors appoints keep any evidence of the expense that this has caused you, such as if you have travelled by car keep petrol receipts, if you have travelled by train or by bus keep a hold of any tickets that you have purchased. If you have been faced with prescription costs then also keep your receipts from these.

As well as costs you should also keep a note of any unpaid care that has had to be provided to you by members of your family or friends. Write down dates and the amount of hours done by your family and friends. One other thing that is important for you to ensure you keep a hold of is your payslips before the accident and pay slips after the accident. This will show the extent of your loss of earnings and demonstrate how this loss will affect your ability to keep up with the demand of payments such as your rent or mortgage.

So why is all of the above crucial to your compensation claim? All of your loss of earnings and expenses that you have encountered since your accident will be calculated to determine the amount of compensation that you will be awarded on a special damage basis. The more you are able to prove about how the accident caused by another person’s negligence has affected your life the more likely you are to make your compensation claim a success.
